DISCO Terms of Service

1. Agreement

By accessing or playing DISCO (also referred to as DiscotheCardGame) — including as a Discord Activity, in a browser, or through related sites we operate (the “Service”) — you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must meet Discord’s minimum age requirements for your region (typically at least 13). If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian who accepts these Terms on your behalf.

2. What DISCO Is

DISCO is a multiplayer card-game Activity and related online experience. The Service is provided for entertainment only. It is not a gambling service, investment product, sweepstakes for cash prizes, or money-transmission service. Virtual items and DiscotheCardGame ORBS have no real-world cash value.

3. Accounts & Discord

When you play inside Discord, we may authenticate you through Discord’s OAuth (including the identify scope, and other scopes we request and you approve) to recognize your account, save your in-game career/progression, and apply purchases or VIP benefits. Your use of Discord is also governed by Discord’s Terms of Service and Privacy Policy.

You are responsible for activity on your account and for keeping your Discord account secure.

4. Virtual Currency — DiscotheCardGame ORBS

In the Service UI we may shorten the name to “ORBS.” In checkout, receipts, and legal documents the full name is DiscotheCardGame ORBS.

• DiscotheCardGame ORBS are our in-game virtual currency used to unlock cosmetic items (fonts, plaque styles, emoji packs, and similar) inside DISCO only.
• Not Discord Orbs. DiscotheCardGame ORBS are not Discord’s platform reward currency called “Orbs” (Quest / Shop rewards). They cannot be redeemed for Nitro, Discord Shop items, or any Discord platform benefit, and Discord Orbs cannot be spent as DiscotheCardGame ORBS.
• DiscotheCardGame ORBS have no real-world cash value, do not earn interest, and cannot be exchanged for money or anything of value outside the Service, except where we explicitly offer a refund required by applicable law.
• DiscotheCardGame ORBS and cosmetic unlocks are a limited, revocable license to use content inside DISCO — not ownership of digital property.
• They are generally non-transferable between accounts unless we add an approved transfer feature.
• We may modify, rebalance, add, or remove cosmetic items, prices, and earn rates. For changes that materially reduce the value of unconsumed purchased DiscotheCardGame ORBS or active paid VIP benefits, we will try to give reasonable notice by updating these Terms (new “Last updated” date) and, when feasible, an in-app or Discord announcement.

5. Paid Products

We may offer:

• One-time DiscotheCardGame ORB packs — consumable virtual currency purchased through checkout (Stripe product names such as “DiscotheCardGame 500 ORBS,” “1200 ORBS,” “2500 ORBS”).
• VIP subscription (“DiscotheCardGame V.I.P. Monthly Subscription”) — a recurring monthly plan (currently USD $2.99/month plus applicable tax) that includes, while the subscription is active:
  • Up to 300 DiscotheCardGame ORBS per billing month, granted as 100 ORBS per week for up to three weeks counted from the subscription (or renewal) start date within that monthly cycle,
  • Access to the Plaque Creator and related VIP customization tools,
  • A VIP tag (or equivalent VIP status indicator) and other VIP-only cosmetics/tools we list at checkout,
  • Ability to use custom plaque backgrounds; non-VIP users may be limited to standard backgrounds.

Exact benefits, pricing, tax, and billing interval are shown at purchase (Stripe Checkout and/or Discord in-app purchase if enabled). If Discord Premium Apps or similar monetization applies in your region, purchases through Discord may also be subject to Discord’s Paid Services / Monetization terms.

6. Subscriptions — Auto-Renewal & Cancellation

If you purchase a VIP subscription:

• It renews automatically each monthly billing period until you cancel.
• Payment is processed by Stripe and/or, if enabled later, Discord’s in-app purchase flow. We do not store your full payment card number. Tax may be added at checkout based on your location.
• You may cancel before the next renewal to avoid future charges. After cancellation, VIP perks typically continue until the end of the current paid period unless stated otherwise at checkout.
• Weekly DiscotheCardGame ORB grants (100 × up to 3 weeks per month) are tied to an active subscription and the grant schedule from that period’s start date. Missed weeks while inactive are not retroactively credited unless we choose to grant them as a promotion. There is no fourth weekly ORB grant in a monthly cycle unless we later advertise one.

7. Refunds

• Except where required by law, subscription fees and consumed DiscotheCardGame ORBS / unlocked cosmetics are non-refundable.
• If mandatory consumer law in your region (including certain EU/UK digital-content rules) gives you a cooling-off or other refund right, we will honor that right when it applies. Contact us promptly with your order details.
• Chargebacks for legitimate delivered digital content may result in suspension of the associated Discord-linked account pending review.

8. Acceptable Use

You agree not to:

• Cheat, exploit bugs for unfair advantage, or use unauthorized automation.
• Harass, threaten, or publish illegal content through in-game features or feedback channels.
• Reverse-engineer, scrape, or overload the Service.
• Sell, trade, or advertise real-money transfers of accounts, DiscotheCardGame ORBS, or unlocks outside approved channels.
• Impersonate others or misrepresent affiliation with us or with Discord.

We may suspend or terminate access for violations. To report issues or policy concerns about the Service, use in-app feedback or email capscrewunlimited@gmail.com.

9. User Content & Plaque Creator

If VIP or other features let you upload images or text for plaques or profiles:

• You retain ownership of what you upload, but grant us a license to host, display, and process it solely to operate the Service.
• You must have rights to anything you upload (no stolen art, no illegal material, no deepfakes of real people without consent).
• We may remove content or restrict features that violate these Terms or applicable law.
• You agree to indemnify and hold us harmless from claims arising out of content you upload or your misuse of Plaque Creator, to the extent permitted by law.

10. Game Assets, Fonts & Third-Party Materials

DISCO includes artwork, sounds, fonts, and UI materials owned by us or licensed from third parties (including Google Fonts and various commercial or personal-use font foundries).

• Your license to use in-game cosmetics does not grant you a separate license to extract, redistribute, or use those fonts or assets outside DISCO.
• Some bundled display fonts are licensed for use inside the Service only. We are obtaining or verifying commercial rights where required before wide public release.

11. AI-Assisted & Generated Visual Content

Some in-game visuals (including emoji sprites, mascot art, and promotional graphics) may be created or refined with AI-assisted tools. You acknowledge:

• These assets are provided for in-game entertainment only and have no real-world monetary value.
• AI-assisted output may contain imperfections; we provide them “as is” for gameplay cosmetics.
• Unless we explicitly say otherwise, AI-assisted game assets remain our property or are used under licenses that permit distribution inside DISCO.
• User-uploaded content in Plaque Creator is your responsibility; do not upload material you lack rights to, including unlicensed AI outputs of third-party IP.

12. Intellectual Property

DISCO, DiscotheCardGame, its name, logos, rules, code, and original art are owned by Cap / Capscrew Unlimited or licensors. These Terms do not transfer any IP rights to you except the limited license to play and use unlocked cosmetics in the Service.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Online games may have downtime, desync, or data loss despite backups. We do not guarantee uninterrupted Activity sessions, cross-device parity, or preservation of all progression in all failure scenarios.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limits; in those cases our liability is limited to the minimum permitted by law.

15. Changes

We may update these Terms. We will post the new “Last updated” date at the top of this page. For material changes we will also try to announce in Discord or in-app when feasible. Continued use after the effective date of changes means you accept the updated Terms, except where mandatory law requires a different acceptance method.

16. Termination

You may stop using the Service at any time. We may suspend or terminate the Service or your access with or without notice. Upon termination, your license to use virtual items ends except where law requires otherwise.

17. Governing Law

These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply. Courts in Michigan may hear disputes unless a mandatory consumer venue rule in your home jurisdiction requires otherwise.
